GENERAL TERMS and CONDITIONS: FEDAS Product Classification Key (PCK)

The FEDAS Standardization Organisation develops and distributes standardized product data and the FEDAS PRODUCT Classification Key (PCK) for sports articles, copyright (c) FEDAS, Gutenbergstrasse 6, CH-3011 Bern (Switzerland). FEDAS alone is entitled to update it without advance notice.
The user, by duty of association, is considered to be the owner of the device on which PCK is loaded and the person who loads PCK.
The licence entitles the user to install a copy of a downloaded PCK inc. updates on an EDP system for his own use.
The single user subscription is indivisible and non-transferable. Furthermore, all rights to PCK remain with FEDAS, in particular national and international copyright. Without written permission from FEDAS, the processing, reproduction, offering for sale, passing on or transmission of PCK is expressly prohibited, regardless of the form taken or means used.
In addition to purchasing a single licence, the user can apply to FEDAS for a
group licence
to cover PCK installation on larger systems or installations on third-party system equipment (secondary user) by specifically declaring the number of EDP work stations that are to be installed with PCK and naming seconday PCK users to be included under the group licence. FSO will respond with a price quotation and special contract terms. The user then expresses acceptance or non-acceptance.
After completion of the contract, the group licence entitles the user to install, or cause to be installed, a copy of PCK and any updates at his own location and that of declared secondary users for the number of EDP work stations declared.
The group licence is indivisible and not transferable by the user. Furthermore, all rights to PCK remain with FEDAS, in particular national and international copyright. Without written permission from FEDAS, the processing, reproduction, offering for sale, passing on or transmission of PCK beyond the group licence granted is expressly prohibited, regardless of the form taken or means used. The user obliges secondary users to adhere to the terms of the group licence contract and guarantees their compilance with it.
Swiss law applies and the place of jurisdicition is the location of the operating authority.
